Traumatic Brain Injuries in the United States and New Mexico
The Centers for Disease Control (CDC) estimates that more than 5.3 million Americans, or about 2% of the U.S. population, are impaired by TBI and require assistance. According to the Brain Injury Association of America, more people suffer brain injuries each year than breast cancer, HIV/AIDS, spinal cord injuries, and multiple sclerosis combined. New Mexico has a high incidence of brain trauma because of the high accident and injury rates. Nationally, TBI rates are estimated to exceed 1.4 million per year, of various levels of severity. There is a significant risk to persons now living of having a brain injury at some point in their lifetime. The financial cost of brain injury is in excess of $65 billion per year.
When a person suffers TBI due to someone else’s carelessness, the losses sometimes are balanced by holding the party at fault accountable and requiring payment of what are called “money damages,” the rough financial translation of the losses, thereby lessening the effects of some of the harms caused. The underlying idea is to make the injured party whole, to restore balance. That is what we do as attorneys.
